Context: Our governments at the center and states are facing a real governance issue in managing Nyaya and Niti as the foundations of thriving civilized society.

The 3 Guiding Principles for enhanced environment and better governance:

  1. Neeyat: good intent.
  2. Nyaya: efficient laws.
  3. Niti: effective conduct.

Issues with governance:

  • Dubious Neeyat: Maligned intent hampers the creation of a positive environment for businesses to prosper.
  • Ambiguity in laws: The Supreme Court recently diluted the principle of Promissory Estoppel affecting both the business atmosphere and Niti of the businessmen.
  • Nyaya and Niti, being intertwined, showcases the influence of fair and transparent Nyaya over Niti of the businessmen.
  • Proper and righteous conduct by citizens is severely inhibited because greed overpowers goodness.
  • Failing aggregate machinery of government: The Center-state system has become a liability instead of an asset due to its failure in performing its responsibilities.
  • Marred with sloganeering: like Make in India, Vocal for Local, Minimum Government, Maximum Governance, and pragmatic actions are ignored.

Way Forward:

    • Nurturing business atmosphere:
      • Role of Companies: Bad Neeyat must be deplored while honest risk-taking must be encouraged, the role of National Chambers of Commerce and MSME are due in this regard.
      • Public leaders should set an example: while nurturing harmony between the states and lead the public through the process of diagnosis and a shared solution.
    • Citizens need to largely operate in the 1st and 2nd quadrants of the following graph for the ecosystem of trust to grow:
